Abstract

It is very common to read that the contractualism is unable to face the obligations that we have towards non-human animals. In contraposition to such considerations, this article states that the version of the contractualism supported by Rawls offers a framework of reflection able to extend our considerations of justice to non-human animals. Following the Rawlisian approximation to the contract, the ideas of the original position and the veil of ignorance to indicate the plausibility of modeling principles of justice that include non-human animals. In the first section, the objections more commonly presented to extend the justice services to non-human animals are presented. In the second section, I introduce a version of the original position supported by Mark Rowls that states a way to extend what he calls the argument to the intuitive equality towards non-rational beings, and for logical extension to non-human animals.  In the third section, it is discussed that the beneficiaries of the principles of the justice chosen in the original position do not necessarily have to be only those with the required capabilities imposed by the veil of ignorance in the original version.
